What distinguishes collateral estoppel from claim preclusion?+
Collateral estoppel prevents relitigation of an issue actually and necessarily decided in a prior action between the same parties or their privies. Claim preclusion bars an entire claim that was or could have been raised in the earlier suit. The Supreme Court cases emphasize that collateral estoppel applies only when the issue was distinctly put in issue and directly determined.
How does estoppel by deed protect a grantee?+
When a grantor conveys an interest by warranty deed that the grantor does not then own, any later-acquired title passes automatically to the grantee. The grantor is estopped from denying the earlier conveyance. This rule protects marketability and prevents the grantor from retaining title obtained after purporting to convey it.
When may a servitude arise by estoppel under the Restatement?+
An attempt by fewer than all owners to create a servitude does not bind non-joining owners but creates rights enforceable against those who joined. The attempt may later support creation of a servitude by estoppel if the non-joining owners' conduct induces reasonable reliance.
