How does a legal life estate differ from a conventional life estate?+
A legal life estate arises automatically by operation of law, such as dower, curtesy, or homestead statutes, whereas a conventional life estate is created by express language in a deed or will. The legal life estate therefore carries the same possessory rights and waste duties as any life estate but originates without a voluntary grant.
Can the holder of a legal life estate sell the underlying fee simple?+
No. The life tenant may convey only the life estate itself. Any sale of the fee simple requires joinder of all remaindermen or a court order based on changed circumstances, because the life tenant lacks authority to bind future interests.
Does a constitutional homestead create a legal life estate that offsets the statutory homestead allowance?+
Yes. Under Uniform Probate Code section 2-402A the value of a surviving spouse's or child's constitutional homestead right is charged against the statutory homestead allowance to the extent the home is part of the decedent's estate. The charge prevents double recovery of the same economic benefit.
