Retraction After Position Shift
After Morgan Financial told Marathon Logistics it would not deliver goods by the agreed date, Marathon began sourcing replacements from another supplier at higher cost. Morgan then notified Marathon that it would perform after all. Marathon refused and sued for repudiation. Because Marathon had already shifted its sourcing plans before receiving the retraction, the retraction did not nullify the repudiation.

The assignment required Mirage to provide detailed weekly reports and accept variable delivery schedules never required before. Mirage refused to perform for the assignee. The assignment was ineffective because it materially changed Mirage's duties and increased its burden under the contract.

Musa Mensah and Melissa Mills signed a premarital agreement waiving spousal support. Five years after marriage, Musa suffered a permanent disability that prevented him from working and left him eligible for public assistance. Melissa sought to enforce the waiver.
