1
in criminal law
An affirmative defense available when a person who has taken substantial steps toward a crime abandons the effort or prevents its commission under circumstances showing a complete and voluntary renunciation of criminal purpose. The defense requires that the decision to desist not be prompted by increased risk of detection or a mere postponement of the crime. It applies to attempt, conspiracy, and solicitation under the Model Penal Code framework.
2
in estates and commercial law
The express or tacit abandonment of a right or claim without transferring it to another party. In probate administration a personal representative may renounce a will's compensation provision before qualifying and claim reasonable compensation instead. In commercial paper a holder may discharge a party's obligation by a signed record renouncing rights against that party.

Renunciation Defense to Attempt
Ruby Rivera loaded a gun and drove to the victim's house intending to commit murder. Halfway there she stopped, deleted the victim's address from her phone, and drove home without approaching the house. Because her decision reflected a complete and voluntary change of mind rather than fear of detection, the renunciation prevents liability for attempted murder.
No Renunciation Defense to Solicitation
Ricardo Rojas approached a friend and offered money to assault a rival. The next day Rojas told the friend to ignore the request. Under common law the completed solicitation cannot be undone by later withdrawal, so the renunciation does not shield Rojas from the solicitation charge.
Renunciation Defense to Conspiracy
Rina Rahman and a colleague agreed to falsify safety reports for a construction project. Rahman later deleted the false data from the shared server, notified the client of the accurate results, and halted the shipment. Because she thwarted the conspiracy through a complete and voluntary renunciation, the defense shields her from conspiracy liability.
Frequently Asked4
What must a defendant show to establish the renunciation defense to attempt under the Model Penal Code?+
The defendant must prove that he abandoned the criminal effort or prevented its commission under circumstances manifesting a complete and voluntary renunciation of criminal purpose. The decision must not be motivated by increased risk of detection or by a plan to resume the crime later or against a different victim.

Does renunciation provide a defense to common-law solicitation?+
No. Once the solicitation is made, subsequent withdrawal or renunciation ordinarily does not constitute a defense. The offense is complete at the moment the solicitation occurs.

Renunciation of Executor Fee
Ronald Reed was named executor in his aunt's will, which set his fee at a flat $2,000. Before filing the petition to qualify, Reed submitted a written renunciation of that fee provision to the probate court and requested reasonable compensation instead. The court may award him reasonable compensation because the renunciation occurred before qualification.
Renunciation of Note Obligation
Rebecca Ross held a promissory note signed by her former business partner. She signed a record stating she renounced all rights to collect on the note and delivered it to the partner. The renunciation discharges the partner's obligation to pay the instrument.
Frequently Asked2
When may a personal representative renounce a will's compensation provision?+
A personal representative may renounce the will's compensation provision before qualifying and then claim reasonable compensation, provided there is no separate contract with the decedent fixing compensation. The renunciation must be in writing and filed with the court.

How does a holder discharge a party's obligation on a negotiable instrument by renunciation?+
The holder may discharge the obligation by an intentional voluntary act such as surrender or cancellation of the instrument or by agreeing not to sue or otherwise renouncing rights against the party in a signed record.
Renee Rogers asked a coworker to start a fight with a visiting inspector so the inspector would be removed from the site. The next day Rogers persuaded the coworker not to act and arranged for extra security instead. The successful prevention of the crime under circumstances showing complete and voluntary renunciation supplies a defense to the solicitation charge.
What additional requirement applies to the renunciation defense in conspiracy cases?+
The actor must have thwarted the success of the conspiracy, not merely withdrawn from it, under circumstances manifesting a complete and voluntary renunciation of criminal purpose.
