Stonehaven Properties holds a first mortgage on a warehouse owned by Sterling Manufacturing. Solstice Ventures later records a junior lien for unpaid construction work. When Stonehaven Properties accelerates and forecloses without joining Solstice Ventures as a party, the sale proceeds to a third-party buyer. Solstice Ventures later asserts that its subordinate interest survives because it received no notice and was not made a necessary party to the proceeding.
Senior Mortgage Modification Prejudices Junior
Sterling Manufacturing borrows from Synergy Systems under a senior mortgage containing a modification reservation.
