How does a written renunciation differ from a release under contract law?
A written renunciation discharges a negotiable instrument without consideration and need only show clear intent. A release under the Restatement (Second) of Contracts requires delivery and may be subject to conditions.
Must the writing be recorded to be effective?
Recording is required only when the instrument affects real property title, such as a mortgage satisfaction. For ordinary negotiable instruments, delivery of the signed writing alone discharges the obligation.
Can a written renunciation be revoked after delivery?
Once delivered, the renunciation takes effect immediately and is irrevocable absent fraud or duress in its procurement.
Does lack of independent counsel invalidate a written renunciation in a premarital agreement?
Yes. The Uniform Premarital and Marital Agreements Act requires either independent representation or a conspicuous notice of rights waived. Absence of both prevents enforcement of the waiver.
