When may a judge engage in ex parte communications for scheduling or administrative purposes?+
A judge may do so only when circumstances require it and the communication does not address substantive matters. The judge must reasonably believe that no party will gain a procedural, substantive, or tactical advantage. The judge must also promptly notify all other parties of the substance of the communication and give them an opportunity to respond.
What disclosure duty applies to a lawyer appearing in an ex parte proceeding?+
The lawyer must inform the tribunal of all material facts known to the lawyer that will enable the tribunal to make an informed decision, whether or not the facts are adverse. This duty continues through the conclusion of the proceeding.
Does the Ex parte Young doctrine permit suits against state officers for prospective relief?+
