Tyler Taylor received a traffic ticket from a state trooper for speeding. The issuing authority sent Tyler a written notice requesting that he waive formal service of the summons attached to the ticket. Tyler ignored the request and forced the authority to incur the expense of personal service.
Tamara Tan was served with a speeding ticket that included a summons to appear in municipal court. Thirty-one days later she attempted to remove the case to federal court. The court dismissed the notice of removal as untimely.

Tanner Thompson failed to appear in response to a parking ticket that functioned as a summons. The judge issued an arrest warrant after the government requested one because of the nonappearance.

A traffic ticket often functions as both the charging document and the summons. When the ticket itself gives notice of the charge and commands appearance, separate service of a summons may be unnecessary.
Removal is available once the defendant receives the initial pleading or summons through service or otherwise. A ticket that sets forth the claim and requires appearance can start the thirty-day clock.
Any person authorized to serve a summons in a federal civil action may serve the summons portion of a criminal ticket. Only a marshal or other authorized officer may execute any accompanying warrant.
