Railroad Right-of-Way Dispute
Prosperity Investments acquired land subject to an old railroad easement held by the United States. After the railroad abandoned the line, Prosperity claimed full present possessory rights. How does a present possessory interest differ from a future interest?+
A present possessory interest gives the holder the immediate right to possession and use. A future interest defers that right until a prior estate ends or a condition occurs. The distinction determines who may currently occupy or control the land and who holds only an expectancy.
When does a present possessory interest terminate upon revocation of consent?+
Consent ends when the possessor communicates revocation to the actor who knows or has reason to know of it. After revocation the actor no longer holds a present possessory interest and may be liable for trespass if entry continues.
Does an estate at sufferance qualify as a present possessory interest?+
No. An estate at sufferance arises only after the original possessory interest has terminated. The holdover tenant lacks any present right to possession and remains solely by the sufferance of the true owner.
